Common law refers to the body of law that is comprised of court opinions rather than statutory law, which is the law passed by legislators (e.g. Congress or Parliament). In the U.S., a lawyer does not “practice common law” specifically. Rather, it is part of the law that a lawyer uses along with the other sources of law: statutes, agency decisions, constitutional provisions, etc. that affect the particular issue that the client faces. Moreover, much law in the U.S. now is statutory law and agency regulations; there is less reliance on common law. For example, there are no longer prosecutions in the U.S. for common law crimes—all crimes are now statutory. Is there something particular about common law that you were interested in? It is a very broad subject.
