Treasurer time up

Recommended Posts

Posting for a friend, a Treasurer/Secretary's term is up, per the Bylaws.  However, he does not want to leave his position.  He insists that the President, who resigned recently, gave him a 2 year term and he's only served one.  He was appointed to a vacant position and served the remainder of that term per the Bylaws.  How can they make him leave?  They've provided all the documentation proving it and delivered written termination notice.  He is the only Director with access to the bank account and refuses to change ownership to the other Directors.  Thanks.

I could probably come up with dozens of things that might be possible.

If the guy won't give his successor access to the bank account and the board can't convince the bank to give access, the HOA may need to take legal action.  Obviously, setting up a situation in which only one person can access the account wasn't very smart.

If the Board of Directors were to pass a resolution firing the treasurer and appointing a new treasurer, and the president were to provide a certified true copy of the resolution to the bank, I think it would be highly likely the bank would shut down access to the account by the old treasurer immediately.
