Theft & Drug Possession at Casino/illegal search?

Recommended Posts

I was recently arrested at a casino. I had taken a ticket for $95 out of a machine. I held it for about 30 minutes and looked for the owner of the ticket, I wasn’t able to to find them and for some stupid reason, I put the ticket in a machine and started playing it. After about 15 mins, security came and asked me to go with him.

State police had an office onsite and I was brought to the back and immediately apologized and said I would pay them the $95 back. That I had about $50 left on that voucher and I could call someone to transfer the money and take it out of the atm. They took my purse from me (after they already had the  voucher and I offered to return the money), and within a few minutes, I was strongarmed and handcuffed to a bench in the office.

Long story short, he then went through my purse and found a small amount of speed in a little tin in a zipper pocket of my purse. There was another little baggie in with it that was actually the contents of an herbal supplement capsule that had been emptied out. He tested both substances right there and in front of my eyes, I could see that one test was reactive and the other wasn’t (super dark blue reaction)

I was arrested and charged with 2 counts of possession and 2 paraphernalia charges- he said the tin that it was in counted as paraphernalia, and of course the theft charge even though the person that the voucher belonged to declined to press charges and was okay with the $50

cash from what was left of the voucher.

The main LEO in that little room then asked me for permission to search my vehicle (I consented at that point, I had nothing else to hide) They found nothing but since it was a plain cargo van, that I had a duffle bag in and some spray foam insulation in some cracks and all where the seats were removed, he started asking me what cartel I was transporting for and talking about calling the feds...

Im mainly in question about whether he had the right to go through my purse after he had the voucher and had removed it off my person as well as what I can do about the second possession and paraphernalia charges.

Thanks so much for reading

Once you committed the crime, there is no undoing it. My guess is that it's legal to search your person and what you are carrying once you have been arrested.

Hire yourself a lawyer and stop admitting to your crimes on the internet.

There's something called "search incident to lawful arrest" that likely will justify the search of your purse.  I suggest you retain the best criminal defense lawyer you can afford and also seek treatment for your drug problem.
