Retail store purchased then sold a T mobile phone that wasn't paid for.

My son purchased a T Mobile  phone off EBay which apparently had not been paid for. They told him he had 60 day guarantee so they won't refund the money for the phone that they sold knowing it wasn't theirs to begin with. They refuse to take responsibility what should he do?

Hadn't been paid for by whom?  Are you saying that the person who sold the phone to your son didn't pay the person from whom he/she/it acquired it?  Are you saying that the person who sold the phone to your son had stolen it?

eBay has a dispute resolution process.  Your son should take advantage of it.

He purchased the phone from a retailer who didn't verify if the phone he purchased from some T Mobile user was paid for. So it's not actually stolen it's just not paid for.                      So the retailer is the middle man and refuses to do anything about it. Said the 60 day time limit was up.

How do you know the retailer knew the phone wasn't theirs to begin with.  Apparently the phone had a valid id and could be activated on your son's account and used for for more than 60 days.  Has you son contacted T-mobile about how much is owed on the phone?
