Visitation after Adoption

Recommended Posts

Adoption and termination of rights ends any connection between the child and parents.  If the parents "appeal" for visitation they will be the same as any person on the street.  That is, they no longer have any "right" to visit the child.  The adoptive parents have the absolute right to prevent visitation if they choose.

I think you are misunderstanding something. There is apparently a 6 month probationary period between placement and the final order during which the home situation is monitored.

There are several options for revocation of consent by the birth parents: 63.2-1204, 63.2-1223 and 63.2-1234.

As for the birth parent(s) having any post adoption contact with the child it's entirely up to the adoptive parents per 63.2-1220.2 through .4.

The adoption statutes can be read at:

https://law.lis.virginia.gov/vacode/title63.2/chapter12/

Please rely only on the statutes and what your lawyer tells you, not anything else that you read on the internet.

Can a parent appeal for visitation after their rights were terminated and the child has been adopted in the state of Virginia

I don't really understand what you're asking.  In the legal world, the term "appeal" means to ask a higher level court to review a decision of a lower level court for errors (it can also apply within governmental entities, but it's the same basic concept).  Colloquially, to appeal means "to ask for aid, support, mercy, sympathy, or the like; make an earnest entreaty."

If an adoption was the result of the involuntary termination of parental rights, then the parent(s) can appeal that ruling, but "appeal for visitation" doesn't make much sense.  If you're using "appeal" in the colloquial sense, anyone can ask for anything.

We are reading that in Va the parent has 6 months to place an appeal, is that correct?

Reading what/where?
