Preliminary? Does DA have right to hold over my head

4 posts in this topic

Ok I have a criminal case ongoing. I went to arraignment... a setting here n there and it's currently time for preliminary hearing. The DA has told me that they will not be any negotiations or offers made unless I wave my right to the preliminary hearing.

Can he hold a part of the due process, our judicial system put in place like that. He is bullying me around and intentionally forcing me  to do what he wants. I feel like I'm being forced or coherced into any decision from here on out.

Plea bargaining is not part of "due process".  The prosecutor does not have to negotiate with you at all.  Your due process rights entitle you to a preliminary hearing and a trial PERIOD.

Nobody's putting a gun to your head.

Insist on the hearing and trial if you like. Or take a plea. It's entirely up to you.
