ticket for backing up on roadway

We live on a gravel road with approximately 7 houses on the road and the road is about 3 miles long. My son stopped at the stop sign at the end of the road, however, one of the kids had thrown something out the window so his wife gets out to go retrieve it and he backs up to get her. A State Trooper sees him backing up and cites him with backing up on roadway. Its a gravel road, no traffic and no harm done. We have to stop on this road to retrieve mail from our mailbox, pull over for large tractors ect. This same officer has stopped him 3 times but this time he "searched for a reason" literally to give him a ticket. Can he fight this ticket??
