Appellate Court Law in Missouri

My cousin is in a Missouri prison and going through the appellate process. He had a jury trial. The appellate court judge

is the same judge he had at his trial. How can this be? How can a judge rule against the trial judges actions if he is that

same judge? Is that not a conflict of interest? Also, how many judges should be at an appellate hearing? Thank you for your time.

The exact appeal/motion that he filed matters as to how this goes. It might not actually be an appeal that was filed yet, but some post-trial motion with the trial court. An actual appeal of the trial court decision would go to the Missouri court of Appeals and would be heard by a panel of judges, none of whom would be the trial court judge.
