2 special needs boys rights are being violated

Recommended Posts

our two wonderful sons are special needs and medically challenged. Christopher our  4 1/2 year old son came home on four different occasions from his special ed preschool with signs that he was either being abused or neglected at school. After we confronted the school several times and got no where,  we took him to the Dr and we're advised to contact special victims and cps, which we did.  After the authorities got involved the school kicked Christopher  and Christian out. So since the end of January Christopher has not been in school nor has he had any of his specialized services that he desperately needs. Now Christian (2.5) is without his school and desperately needed services as well.  Please help us get help for Christopher  and Christian, life is hard enough for them on a regular basis without them being abused/neglected at school and then having everything that they know and need taken away from them for no reason. We've even needed to start a gofundme page to raise funds for an educational lawyer which we need.

It's not at all clear what sort of help you're asking for.  You were advised to contact CPS which you have done.  You don't say whether your child's pre-school is a public or private one and you don't identify your state, so it's impossible to determine the nature and level of care (if any) the school is legally obligated to provide, or whether a lawsuit, if that's what you're contemplating, would be effective or even feasible.  In any case, it's doubtful you'd want to return your child to the same environment in which he has already been subjected to abuse and/or neglect in the past.  As for obtaining care and treatment from other providers, that's a medical question and not a legal one, and you could probably obtain better and more appropriate guidance from your child's health care providers than an Internet forum concerned with legal matters.  I don't think there's any help for you here.  I'm sorry.

I'm not sure what the point of your post is -- especially since it's full of conclusory statements and contains almost no facts.  What does "special needs and medically challenged" mean?  What were the "signs that he was being abused or neglected"?  What made the doctor advise you to "contact special victims and cps"?  What resulted from the "authorities" getting involved (other than your kids getting kicked out of their preschool)?  Why haven't you found a replacement school for your older child?  Why does a 2.5 year old need to be in school?  What "services" do they"desperately need"?  What is it that you think anonymous strangers on an internet message board can do for you?

All of the above apply. However, depending upon the nature and extent of their disabilities (assuming there are disabilities), young children can receive services for early interventions under IDEA and Child Find programs. If you have severely disabled children, it is very curious that you would not already know about these programs, but if for some reason you don't, google "NAME OF YOUR SCHOOL DISTRICT Child Find". There may be additional services available under state or local laws, but since you did not share that information, I'm at a loss to check.
