Accident

I was backing out of my drive way the other day and rolled back into a friends car who was also in the drive way. I immediately told him what happened agreed to pay for what i damaged i caused which was a small dent and a couple small scratches on the front fender. We didnt call the police because i have no insurance. 2 days later he calls me with a quote. $800.64, he tells me i have to pay that amount or he will call the police and take me to court. The quote that he got is an obscene amount due to the damage i caused and he refused to get a second quote. I told him i will take care of it but he should find a more reasonable quote. He ended up making a police report and says he is gonna take me to court. I know the accident was my fault but how can i get around paying the amount he is asking or what should i do in court. advice?

If it goes to court you will lose. You can request that he take the car elsewhere for another quote but you can't force him to have the work done by someone you approve of. He doesn't have to try and save you money, though it would be nice if he were willing to consider getting another opinion.

You're free not to pay a dime until he sues you and gets a judgment against you.  If he sues you, he'll have the burden of proving the amount of his damages.  A written estimate or invoice from a body shop will almost certainly suffice, and you'll then have the burden of proving that the estimate or invoice is not reasonable.  Unless you have expertise in auto body damage, your opinion that the amount is "obscene" will be utterly meaningless.

Given your admission that you are driving illegally (unless you're in New Hampshire or in Virginia and pay the required annual payment to the state in lieu of insurance), allowing this matter to go to court would probably be exceedingly foolish.

$800.64 is perfectly reasonable for "a small dent and a couple small scratches on the front fender."

 

Take the estimate and a photo of the damage to any body shop in town and they will tell you the same thing.

If you let this go to court you will lose and also owe him for his filing and process service fees, likely another $50 to $100.

 

You could also potentially get your license suspended for having an uninsured accident.

 

You're between a rock and a hard place and he's got you over a barrel.

 

Pay him.
