Foreclosure Court Jurisdiction New York

Does a County Court have concurrent jurisdiction over mortgage foreclosure actions in New York State outside of New York City or does Supreme Court have exclusive jurisdiction over mortgage foreclosure actions?

What difference does it make to you?

 

In other words, whether one court or another has jurisdiction isn't going to change the process or that you lose your house if you don't make your payments.

 

Explain what's happening to you instead of asking hypothetical questions and you might get some helpful comments.

It makes a difference because if the mortgage holder files for foreclosure in county court that court does not have the power to hear a foreclosure case and the foreclosure action may be dismissed. The lender then must refile in the supreme court (which in NY is the general trial court). In short, it can buy the homeowner some time.
