executors responsibilties

Recommended Posts

I know the executor is responsible for carrying out the will and making sure bills and taxes are paid,etc..however,does the executor have to consult with the other heirs of the will on matters such as how to sell the deceased person's home and property?

It depends on what State you live in too, in California the executor has to consult the heirs.

In addition to the fact that California law isn't relevant to this thread, your statement is inaccurate.  Management of a probate estate is covered in Parts 5 and 6 of Division 7 of the California Probate Code.  Section 9600(a) provides that "[t]he personal representative has the management and control of the estate and, in managing and controlling the estate, shall use ordinary care and diligence."  Section 9610 provides that "the powers and duties set forth in this part may be exercised by the personal representative without court authorization, instruction, approval, or confirmation."  Nowhere does the Probate Code impose a duty to consult with the heirs regarding the administration of the estate, and this is particularly so if the personal representative has been granted authority under the Independent Administration of Estates Act.

If you can cite a statute or case that says otherwise, I'd be quite interested to read it.
