It's got nothing to do with hot pursuit.  The cops were called out for domestic violence.  They get there, no one answers.  For all they know there's a dead body in the house.  They're allowed to go inside.  Once they saw the pot in plain sight.  They stopped, froze the scene and got a warrant.  That's exactly the way the cops are supposed to do it.  The credibility of any witness is for a jury to decide.

If the police are called on a domestic violence incident, they are required in most states to investigate.  These are questions you should be putting to your attorney if you have been charged.  They are more familiar with the local judge's and prosecutors and how they look at these things than stranvers on the internet.

Hi harleychico,

Even if you made it clear that you were not in the house, the police can enter the house to ensure the safety and well-being of all of the occupants (e.g. they might want to check to make sure no children were injured or present in the home).

Since it seems like you have a lot of specific questions, I suggest you consult with a criminal defense attorney regarding not only the the propriety and scope of the police search, but also how to handle the drug paraphernalia issue (especially if you are thinking of implicating yourself and claiming it was yours).
