Legal Consequences

Recommended Posts

What legal consequences would a person be facing if they were charged with possession of marijuana, possession of paraphernalia, driving without a license, two failure to appears, and another driving without a license that was later changed to driving on revoked even though the person never owned a license or a permit?

Depends.  There's more than just one level of possession of marijuana and it also depends upon whether or not the person has any prior marijuana charges.  They could be facing from a max of a year in jail to 6 years in prison.  As for the revoked license, you don't have to have one to have the privilege to drive suspended or revoked and if caught driving, you're facing at least a max of 6 months in jail.  The punishment for failing to appear depends upon the classification of the crime charged that you didn't show up for.  Could be punished from a max of 6 months in jail or up to 6 years in prison....That "person" needs to get themselves a criminal defense attorney yesterday.

It was a simple possession charge and it was the first charge on their record. These charges are the first charges on this person's record. The first failure to appear court date was for the first DWL charge and for the possession charges. That court date was missed due to being stranded out of state. That court date was rescheduled to the same day as the second court date for the second DWL charge and that one was also missed. This person is undergoing a multitude of medical testing and has a heart monitor installed in their chest.

Hi Hopeful_86,

As LegalwriterOne pointed out, this person needs to get a criminal defense attorney ASAP.

First, the court is not going to buy an excuse of "being stranded out of state." And if this person is experiencing severe health difficulties and unable to physically appear in court, he/she needs to contact the court (also ASAP), or this person's legal troubles will continue to compound. Please refer to FindLaw's lawyer directory to access a list of experienced criminal defense lawyers in your area.
