Occupational DR. wont release me

Recommended Posts

My son had a siezure at work (oilfields). Occupational Dr. said  have to cleared by a nuerologist.  The nuerologist gave us a prescription paper saying may return to work no restrictions. ......Occupational DR now telling us it must say " can work in a safety sensitive area-no restrictions"   california law?   Nuerologist is saying his letter was sufficient. so were stuck in the middle...what can we do?

Not sure I really understand your questions.  "[W]hat can we do?"  Given your son's occupation, he's obviously not a minor, so this has nothing to do with you in any legal sense.  If your son's doctor wants the specialist's opinion to say something different, someone should call the specialist and ask for it.

The doctor doesn't get to dictate what the employer deems sufficient. Especially when it comes to a safety sensitive position and a medical condition such as your son's. A blanket "released without restrictions" isn't worth the paper it is printed on.
