Accident while in company car

A familly member was killed in a car accident.  She was a passenger with 2 of her fellow employees in a company car.  They were driving from one job site to another and were involved in an accident.  What kind of liability is involved here?  Does workmans comp insurance cover her funeral expenses and compensate her children in any way because this accident happened while she was at work?

Based on what little you've written it appears that the death was employment related. Workers Compensation would cover funeral costs and provide a weekly benefit for the minor children. However, those benefits vary from state to state. You can google Workers Compensation death benefit with the name of the worker's state and find out what those benefits are.

 

If the co-worker driver was at fault, it's possible that the only benefits would be workers compensation.

 

If a driver of another car was at fault then the estate and the children could have a wrongful death claim against that driver. Should that claim be successful then workers compensation would have to be paid back for any benefits paid prior to the settlement or award.

 

What has the representative or executor of the deceased worker's estate done so far?
