health care benifits

Recommended Posts

I have cancer and have been out of work since 10/29/2013 can my employer cancel my health care benefits.

Presumably the employer could cancel the benefits. Whether it would be legal to do so depends on facts that we don’t have. When you say you’ve been out-of-work since late October, what do you mean — are you on FMLA leave, drawing some sort of short term disability income from your employer, terminated, or something else? What kind of health care benefits are you receiving? How long had you worked for the employer before you stopped working and how many employees does the employer have? And in what state were you working?

In general, if you are out on FMLA leave, the employer must maintain your benefits for the period of the FMLA leave. Once that time runs out, the employer may terminate you and end your health benefits. However, unless your employer is very small, and assuming that your health care benefits are provided under a group health insurance plan of the employer, you’d be entitled to continue your coverage under a law known as COBRA for a period of 18 months (and in some cases longer). Note, though, that you typically pay the full cost of the premium for the COBRA (that is, the employer doesn’t contribute anything towards you COBRA coverage) and you also may be charged an administrative fee of up to 2% of the premium as well. If you are out some sort of short-term disability policy of the employer, the provisions of the disability plan would determine how the health care benefits are handled.

You may find out more about COBRA coverage from the U.S. Department of Labor (DOL) here:

And information about your rights to unpaid leave under FMLA are also available from the DOL here:

My question is what exactly is a employer by law sup post to provide in re guards to medical , dental insurance for  a full time employee at a dental office? Is it my responsibility to pay for my medical insurance with no compensation from my employer?
