employees descriminating other employees

so is it against the law for other employees to decriminate the minioriti of employees do to race?

You don't provide facts--for example, what the discrimination consists of, whether the employees discriminating on the basis of race are management-level employees, etc. Even if non-management employees are discriminating against co-workers, this could constitute harassment for which the employer would be liable.

Your post is short on details, but if a co-worker is mistreating employees based on their race, then presumably you and/or the workers in question have complained to management about this. If you have and the employer has done nothing to stop it, that's where the liability issue comes in. You'd file a complaint with the state human-civil rights commission folks and the EEOC.

If, however, the employer has not been made specifically aware of this behavior, then the employer doesn't have liability. The employer's legal obligation is to see to it that the behavior stops; unlikely to be held liable for something folks won't bring to its attention.
