car parked officer see's two people walking away from car both being on probation. Officer stops and questions both people one being under the influence.Officer never asked to search car and know one in car officer searches car and finds large amount meth amphetamine arrest person under influence for sales of illegal substance .If substance was in car and no one in car ,can this person be charged for this ? Not being the owner of the car.

Do you think there are any circumstances that can justify the officer's actions? In order to detain a suspect, the officer needs generally to have probable cause to search the vehicle and arrest the suspect. Probable cause is based on reasonable belief which is substantiated by facts showing that criminal activity may be occurring.
