Accident with company car

Recommended Posts

Hi my name is Randy Carlson and I work for a security company.

I was involved in a minor accident with the company vehicle .

I hit a snowbank during a blizzard causing a crack in the grill in

front of the car. The security company's insurance is going to pay for the

damage but are making me pay for the deductible which they say is $1000.

Is this legal?

Don't post your name on the internet.

I presume you are referring to the employer vs. its insurance company, but how is it *making* you pay, exactly? Did it file a lawsuit against you and win? If employer unilaterally deducts from paycheck, file a wage claim with the state labor dept. It isn't entitled to take money from your paycheck without your consent, and most states have laws against trying to make the employee pay for accidental damages. They're free to fire you or discipline you in response to the accident, but not entitled to payment. If they think they can prove you did it on purpose, that's another matter -- they're free to sue you for the cost of the damage (not just the deductible).
