If my 17 year old son was refused by the prosecutor to testify in his stepfathers case because he was found not competent, can they trial my son on his charges? Since he is not competent to testify, how is he competent to stand trial?

You're going to need to provide more fact beginning with what state, why your son could be a witness, what he's a witness to and why you think the DA may charge him.
