CIVIL RIGHTS VIOLATION

My corporation was sued in the supreme court in New York. The presiding judge reviewed the Plaintiff's complaint as well as mine, (through my attorney). The judge "sua sponte" transfers this action and ex parte application for counsel fees to a lower town court, and for the amount awarded the plaintiff not to exceed the legal limit of $5,000 in small claims court.

The judge in the small claims court awards an amount exceeding more than the legal limit. I was denied the right to a speedy trial.

Is this considered to be an infringement of my civil rights?

If the small claims judge awarded more than the jurisdictional limit permitted in his/her court, then your recourse would be to appeal.

What makes you think you have a "right to a speedy trial" in a civil matter?
