  1. I have some outstanding medical bills related to an ongoing auto accident claim. One provider sent my account to collections but they still continue to contact me about payment, despite being told by me and my attorney in writing to stop. I received a text alert from them today. Can the original creditor & debt collector both contact me? Do i have any right to file a complaint about one or both companies? Thank you.
  2. Personal injury claim with one minor party who was awarded enough to merit a blocked/restricted trust account via probate court. Petition filed, Conservator appointed, account set up, Acknowledgment signed by bank rep and then filed in probate court. Approximately a month later, the Conservator receives a letter from the bank along with a check for the full amount of the settlement, informing her the account has been closed out. That she's aware of, there was no communication or notification to the court. What does the Conservator need to do to prevent being held in contempt of the original Order? She can't just open a new account, she has no Order as it was filed showing the account was set up. What would she need to file in court? Or is this going to require a probate attorney's help? Can the bank close out court-ordered accounts without first obtaining a court order or at least notifying the court? The Conservator called the bank rep she met with initially and all they would tell her is they can close accounts at their discretion. Thanks!
  3. Assault IV and Criminal Mischief charges were filed on assailant after he entered ex wife's new home and assaulted her and her boyfriend while they were sleeping. Door was unlocked but assailant was not welcome and had never been to the residence before. Ex- wife called 911, assailant left before police arrived. No witnesses, minor injuries sustained. Can an additional charge of burglary be filed against assailant after being released on bond from county Jail?

A newly pregnant co-worker (she announced it to the office April 1 & isn't due until November) has begun making ridiculous demands on everyone around her - sometimes the entire floor/firm - in our cubicle area. Each time, she's gone to the office manager who tends to be overly sympathetic & mothering & cried about whatever issue & then we get a group email. First it was to tell us we need to stop wearing perfumes & lotions & using air fresheners in the bathrooms bc "she can't even". Next we had to change our office lunch plans bc "BBQ is not her friend" and for some reason, getting lunch from 2 places isn't an option? Now we've been told we're being "too loud" and are no longer allowed to listen to music at our desks or take calls on speaker bc it stresses her out too much. We have also been instructed not to speak to each other in the cubicle area unless we get up & walk over to the person to whom we're speaking. One of the partners of the firm sent an email to ALL employees today, again reiterating that WE need to be more "considerate" of this employee and all her demands. They offered to provide noise cancelling headphones for US. I'm aware, of course, of the protections of pregnant ppl in the workplace which are similar to discriminatory & disability laws. But since when is the burden of one person choosing to have a child & the well-known experiences that come with it the responsibility of everyone else? Shouldn't SHE be the one they offer headphones to? This last email from today that came from the one female, mother partner has completely killed the morale that was stellar until shortly before April Fools Day. What can we do to fix this situation without a) making a bad situation worse or b) having to shut up & pander to this insane, entitled person for almost a year??
  5. My son initially was charged with burglary. bonded out then arrested carrying a concealed deadly weapon into the courthouse ( it was a utility knife with compass in a credit card size). Of which he showed the police then bonded out for that arrest. He went to court without a lawyer to plead not guilty and was told if he didnt come back at 1:30 the same day with a lawyer the commonwealth said he would revoke his bond. It was an arainment and I didnt know you had to have a lawyer. Couldn't get his lawyer to return call and my son didn't return. the next day he was late for his court appearance on burglary charges and lawyer wouldn't meet him and go in to talk to judge. He then was picked up by police 5 days later.. he now has a 1st degree bail jumping charge. Would the judge consider a failure to appear charge from bail jumping.?..
  6. I was recently ordered to wear an ankle monitor following DUI conviction. On my court orders, it states I am able to work Monday through Friday 8-4, go to the doctor at two locations (recent broken back), to the lawyers office, and to get the calibration on the intoxilock device on my car. All the addresses are listed on this court order. The company who installed the monitor has been a nightmare. Their rules are to text my next days activities with the time, address, etc. by 5 pm the day prior. I am to text when I leave home, arrive to the first place (my office), then to the next place, when I leave and when I arrive home. I have no problem with this as I only want to abide by my court order and go the places listed on this order. The problem I am having is with the calibration of the intoxilizer, you have a very limited amount of time to get the car to the automotive dealer to get the unit placed or your car will be locked out and will have to be towed to the automotive repair shop to have it installed. I am to call the auto repair company at 1 pm to see if the unit was received by UPS. If it was received, I am to go straight to the auto company to have it installed. There is no time to waste as I have a very minimal amount of time to make it there or the car will be locked out and need towed. I called the lady and explained that I had no idea if the auto company received the unit until that day and if they did I would have to go, if not, I would have to check again the next day. She was extremely rude and stated I still needed to text her the address of the auto company by 5 pm. I immediately got on the phone with intoxilizer to see if the shipment was made and if there was anyway to track it. Of course, I was on the phone on hold past 5 pm. I texted her the address soon after and she told me I couldn't go that I had to sit home. This woman is a nightmare. So, after that on Thanksgiving day, I texted her again stating I was going to the auto place. I still had no idea if they received the shipment or even was open but had no choice to tell her I was going due to fear of missing the calibration and having my car locked out. Of course, they were closed the next day. I texted her I was not going that they were closed. She got upset stating again I needed to make an appointment. I texted back again trying to explain there was no way to do this. I would make an appointment if at all possible but could not. It is obvious the intoxilizer and this ankle bracelet monitoring deal is not working. I cant afford to have my car locked out and towed to the company. She is treating me like I am trying to get away with something. I am still complying with my court orders but it is extremely difficult to work with this woman. What are my rights? Would she be in contempt of court for not allowing me to comply with orders????
  7. Short marriage (2 years). We rented out spouses house for one year during marriage and spent most of the rental money on travel and hired help to build a pool at our joint home. Now with divorce agreement pending, she wants the total spent from the rental property returned to her. Am I being unfair offering only half of it back? Of course she wants a lump sum that I'm unable to do and is refusing to sigh the agreement without a lump sum. Please advise.
  8. When my Daughter and her ex divorced the judge divided up their assets and debts. She was to was given the more expensive vehicle because she was able to keep paying on it while he couldn't. He took the less expensive vehicle. Their credit cards and other bill that were owed were also divided between the two. She has a full time job and he has no job or works on his family's farm and works odd jobs for cash. Anyway, he stopped paying on the bills that he was supposed to take care of and she is now being saddled with those also, because those credit card companies are garnishing her wages. She has also been told that she now owes on a loan that she can't remember even signing for. What kind of recourse does she have for this? She has been told that she cannot file for bankruptcy unless he also he agrees to it also, which he said he won't do. She is getting so far in debt now that we are trying to help as much as we can. This is in Kentucky. Please help!!
  9. I recently began a new job with a company that contracts services to various sites throughout the region. At the time of my hire I was told the site where I would be assigned initially would be closing in the near future, at which tine my coworkers and I would be transferred to other locations. We have since learned that we will likely remain at our present site for longer than expected, however we would be responsible for less duties therefore our hourly wages would decrease. In other words, we will be working the same amount of hours but doing less for a lower rate of pay. The employment agreement I entered into at the time of my hire states that there is no guarantee of shift, days off and/or job location, however there is no mention of anything to imply my rate of pay could or would change. I'm wondering if this is legal...
  10. I was in an accident which caused me to have a penile fracture. I was rushed into surgery and afterwards I had several complications including bleeding and infection. Now two months after surgery my ----- is severely crooked and --- is painful do I have a case?

Went to Dr. for a cold .Had Mass in Chest ,was sent for a Biopsy and told it was Small Cell Lung Cancer and had to move very quickly to be able to have a chance at life.(up to 5 yrs if it worked).Went through 30 radiation and 7 chemo treatments ,and 7 surgerys and 16 different scans was told that it had not changed at all and that a new biopsy needed to be done .This time instead of doing it and having their pathologist read it they sent it out and come to find out I did NOT have Cancer .I have a paraganglioma and am right now waiting to be transferred for surgery .After going though almost 7 months of being treated for something I did not have and now being told because I did have the chemo radiation and all the scans I could get cancer in the future ..Not counting all the costs to the Insurance (worried I will meet my cap on insurance when I need it most ) I just wonder do you think I have a case ..Or should I just count it as a blessing to still be alive .When nothing was working the surgeon told me if I didn't do more Chemo that I would not be here in 6mths to a year .Even though the oncologist had stopped the chemo.
  12. I live in the state of Kentucky..Can my husband and I do our own will's? We own our home and have stock everything be divided equal between our 2 kids .to do as they see fit ,they divided equal between our 6 grand kids
  13. So, we're in the process of moving to a new place and our move-out date, noted on an intent to move-out notice, was July 31 (same as last day of lease). On Friday, our computers's maintenance came in and removed remaining belongings, trashing some and the rest nowhere to be found. They admit this much, and that it was wrong. but I'm unsure of how wrong they are here. Are they responsible only for straight replacement of the items? Because there's been destruction of items with irreplaceable sentimental value, there's been stress over trying to figure out what happened and having to dig some of it out of a dumpster, and there's the violation of their doing all of this without any notice, illegally, while we still occupy the apartment. It seems wrong on a higher level than just erroneously tossing out stuff (I would think they'd need to hold or do something other than immediately trash it regardless, actually).
  14. I purchased a flat fee mls listing through on a website. They advertise that if you do not sell through buyer agent you can sell free of this charge. Local agent they referred me to that will post listing says you cannot advertise on another similar site. Does Kentucky MLS law restrict me from advertising fsbo outside of MLS?

My wife's uncle gave her a trailer back about 12 years ago she never had to pay rent it was said that he gave it to her so me her and are two kids have lived here for the whole 12 years and now he says we have to move in a month cause water is running off the mountain behind us and going in his yard only thing I want to know is does my wife have any right at all with him never giving her a deed
  16. My mother died in 2003 WITHOUT a will. My stepfather stated in a court document, at the time of her death, that she had only two living heirs; my stepfather and their son, my half brother. I wrote a letter to his attorney disputing this document, with no reply. (She had remarried back in the late 1970's and had one child with my stepfather.) At this point, my stepfather is in bad health. He just stated to me that all contents and his and my mother's home, according to his will, will be left to my half-brother ONLY. The property is still listed at the PVA office as (exp:) DOE, John and Jane EST. Can he leave my mother's half solely to my half-brother and leave me out of my mother's half of the property and/or real estate?
  17. I live in KY. My grandmother owns the property where her house sits on the right and my uncles house on the left. She said I could put a double wide next to her house but won't sign a deed for that bit of land over to me. She's 85 years old. When she passes the land on her side is supposed to go to my son, the land where my uncle lives is supposed to go to his son. My double wide would be located where my son inherits. No one has seen the will so I'm not sure who gets what. My grandmother says she will sign a paper saying I can live there till I die. I know the double wide will be mine legally but what about the land it sits on? Can anyone make me move or pay rent? My grandmother has 5 kids and 10 other grandkids. She wants the land to stay in the family and not be sold. Is there something I can write up, without going to a lawyer, that gives me rights but I can't sell it? If my son does get the land, that's great, but what if it goes to someone else? I was also told if she had to be put into a nursing home they would take her land anyway. How could I keep my part from my aunts, uncles, cousins, or anyone? I just want to make sure once I put all the work into that no one can swoop in and take it from me after she passes. I plan on giving everything to my son either way. Is there anyway I can see what's in her will? Can the nursing home really take someone's land? Any advice would be appreciated. Thanks.
  18. If property was purchased during a marriage and both spouses are on Deed but no on Loan....if the divorce decree doesn't state a split of property, do they both still own house in Kentucky? If they asked their former spouse to pay them half, is that legal? thanks
  19. Two weeks ago my youngest broke her arm and dislocated it. We want to hospital and we were transfered to the children's hospital becauzs they said she needed surgery to fix the break. They didn't do surgery they did a closed reduction put her in a half cast dent us home. So as told I called scheduled appointment for following week as directed. We go to this appointment Dr says she's OK but concerned. Come back next week see yethe another Dr. This Dr comes in (still no change in break) tells me her break is very extrwme and needs urgent surgery. Well she had surgery yesterday nails screws. The dr told me her nerves been damaged and her hands been contracted she's going to need months to regain use of hand and arm... my question... is this normal protocol because multiple people have told me to talk to a lawyer NOW... you can see in x-rays by the way the radical head is not right at all... please help
  20. I was recently terminated from my place of employment a few days short of completing my 8 month probationary period. Because it was a probationary dismissal my former employee was not required to provide me with an explanation/reason for the dismissal, however since my attendance, job performance, attitude, etc. met or exceeded expectations I firmly believe it was in retaliation for my reporting an incidence of harassment that occurred approximately a month earlier. The incident involved harassment toward myself by two of my immediate supervisors. Following my report I was interviewed by my agencies internal affairs office and immediately reassigned to a different shift. (Perhaps I should mention that at the start of my employment I was asked to list my shift preferences and the shift I was moved was my last and least desired choice.) During this interview I provided the names of several coworkers with whom I'd known to have had experiences to my own with the supervisors in question however the only people present at the time of my harassment were the two supervisors and myself. I was instructed by the internal affairs office not to discuss this situation with anyone and I did not, nor am I privy to any of the details regarding the investigation that ensued, if one if fact did take place. I do know however that neither of the supervisors in question received any disciplinary action as a result of my report. Following my sudden and unexpected dismissal I contacted the coworkers I mentioned as potential collaborating witnesses and learned that they were never contacted about the matter. I feel that my report of harassment and the ensuring investigation were improperly handled and that my dismissal was in retaliation however I am seeking advice regarding how to prove this or which steps I should take from here that may help improve my chances of winning an appeal to the personnel board. Thank you.
  21. My step-daughter lives in Kentucky with her mother. She was born overseas. Her mother is not a US citizen. She and my husband were never married. My husband is not listed on her birth certificate but a home dna test verified he is her biological father. He is a US citizen. In 2013 my husband and I were able to start having a relationship with his daughter. Last year her mother filed for state aid in Kentucky and we were asked to come to court for child support, which we were happy to do. When the mother found out we were coming to court, she dropped the court case. My step-daughter has called us letting us know that there is no food in the house. She often has to visit a neighbors house to eat in the evenings. Her mother makes her call her grandparents (my in-laws) to ask for money for their bills. At our suggestion, our daughter has started telling her mother that she needs to make the phone calls herself. When my in-laws started refusing, her mother started calling my husband. She has threatened to not allow us to see her. In the last couple of months my husband and I have paid to keep their water on, and been hounded by her mother to pay her other utilites. The mother signed tax documents allowing my husband to file for the child tax credit. When we attempted to file the taxes they were declined as someone had already claimed her on their taxes. The mother has, over the last week, spoken to others about one person, one way bus tickets to California and plane tickets overseas so that "she and her daughter could go live there". The utilities are due to be turned off this week, and money received from her ex-husband (not my husband) was sent to a boyfriend. Our daughter is upset, scared, and exhausted from the fighting and idea of being taken away from my husband. We don't have the money for attorney's fees and we don't know what to do.
  22. We had our mediation done on November 14th and the judge has yet to sign it and give it to child support. My ex has been paying weekly so there is a large amount of money just sitting somewhere. No one can give me any answers over the phone because of confidentiality, so I was asked to go down there myself just to be told it's sitting on a judges desk still. I filed for child support on July 5th and we've had no help from my sons dad since well before then. Is there any way to figure out what judge has our orders? They won't tell me anything and I can't afford to take off work to drive down there for no answers.TIA
  23. I am curious... Are these even legal? I was a couple days late on rent paid in full plus the 20$ a day late fees on a 600$ a month rental 1 yr lease. He had put a notice on our door to vacate in 15 days ..... no reason just to leave. He tries to scare the tenants here all the time calling the police on the kids and threatening to evict people with his 15 day notices. He told a little boy today who was hanging out with friends to go back to his country. He told another tenant to pay late fees when they weren't even late they asked for a copy of the lease and he gave them a copy that wasnt even signed by them. The apartments have mold and mildew, Have holes in the carpets he said he was gonna fix. I want to know if we have any rights on him fixing mold issues and holes in the carpets. He is a complete slum lord by all means. I wish I woulda known this before moving in buy now I am stuck till next yr because of our lease agreement. Thanks for the help if you have any.
  24. My mother does not currently have custody of my sister and I. I am 16 and she is 14. I live with my aunt and uncle and she lives with her father, we are not happy living where we are now, although we are given what is required such as food, clothes and shelter. our mother was a drug addict and though it was in our best interest for us to choose a family member and she signed over guardianship to that person that we chose. she is now clean from the drugs, she has a job, she has a house, and she is financially stable, and is ready to get us back. we want to move in with her, but our current guardians are willing to fight for us to stay with them even though we don't want them to. what are the chances that the court will re-grant our mother custody of us? How long will the court hearings last. like week months, or what? and finally will we have to keep living with our current guardians while the court hearings are going on? p.s in our official court papers it says that we should be getting visitation with our mother that we are not currently getting because our current guardians don't allow us to do so. Also, my mother never terminated her parental rights, she just signed over for guardianship.
  25. My lease states that I must pay the bill for my alarm system, we do not want the alarm nor do we feel it is necessary and it is an added expense we do not wish to pay for. My landlord states that the lease says we must maintain the alarm and pay the bill for as long as we are in the home and failing to do so will violate our lease at which time he will take the necessary action against us. We have read the lease and it only says we must pay the bill, not maintain the alarm, it says we must pay the bill for the gas and electric, cable, phone, internet, water and alarm. If I wish to cancel my cable service I am completely within my right to do so and we don't even have phone service in the home, we use our cell phones. So with the wording as it stands should we be allowed to cancel the alarm without further action from our landlord?
