  1. My mother in law was at a residence with a friend. The cops came with search warrant, they all went to jail. They took all her stuff out of her truck( purse, wallet, phone, mail, and more) left it at the residence. She told the cops she didn’t know the people, now all of her things are gone. Is there anything she can do about this? Are the cops liable? Thank you in advance.
  2. My child's mother has always kept my contact with her EXTREMELY limited! Although we planned to have a child together, after our success, she basically ghosted me; began dating other guys, and avoided my efforts of staying in contact w/ her. I wasn't even informed until a couple of days after my child was born to come to the hospital to finally meet our newborn. We were really young when our child was born, not even out of high school, so it was all so brand new, and quite frankly, terrifying. Yet, I was really excited and couldn't wait to be a dad! It's been nearly 10 years, since my child was born, and since I've physically seen my child at the hospital. My child's mother claims that my family is against her b/c she's Caucasian (and we're Black), but that's not true whatsoever! She's told me that I lack consistency and that's why she doesn't want me around our child... I'm always having to contact other, mutual people or make new Facebook pages, just to get in contact with my child's mother. Every chance I get when I'm "welcomed" I save any and all photos, since my child's mother won't allow me to be around or stay in contact. Yet, she winds up blocking me/changing her phone number if I don't move as quickly as she'd like me to, and so, I have to begin again with trying to locate her new number or making a new Facebook page. Our child's mother is now married, for the 2nd time, and also has 2 more kids. Before this current marriage, but after her 1st marriage, she and my child moved in with a boyfriend of hers for a few months. Her current husband wants to adopt our child. I've been avoiding dealing with the courts b/c I've always felt it unnecessary and a waste of money, money that can go to my child, instead. I never signed the birth certificate, nor have I established paternity. I know the child is mine though. I don't want my child to be adopted by their stepparent... I've been reading up on different cases and other legal information, and it sounds like even if I do establish paternity/petition to legitimate, I'd be denied due to abandonment of opportunity interest. Is there any chance that I'd have a chance or am I as doomed as ever??
  3. For a Riverdale, Georgia case; I posted a cash bond for someone and was expecting a refund. Should the person that the cash bond was made for be able to decide what happens with the cash bond? They went to court and was ordered to pay fines and fees. After the court date, the cash bond was applied to the fines and fees. I didn’t sign any paperwork agreeing that the cash bond could be applied to fines and fees. Is there anything that I can do to get the court to correct this?
  4. Court order: “ child due to be emancipated witching 2 years ( anticipated upon graduation from high school, occurring after 18th bday). Worksheet shows a step down in child support once *** is emancipated. Beginning one month following ****’s emancipation, father shall pay $$$ in monthly child support.” Child is 18 years and 8 months old. Age of majority is 18 in state of Ga. therefore child is emancipated. Child has been in 11th grade homeschool for the last 3 years. Child’s “ anticipated” graduation from date of court order was May 2019. Apply step down amount of child support?
  5. My father passed away last year, he owned a successful business in grave digging. He did not have a will when he passed away. My step mother got everything and did not share any of my father’s estate with my sister and I. Is this legal? If not what should I do? Can a lawyer take his fees out of winning settlement if granted since I have no money to pay up front? PLEASE HELP!!
  6. Hello, I have a question about my citizenship status. I was born in Canada in 1969. My birth mother, who is Canadian, divorced my birth father (who is American and was living in Canada at the time of my birth) and moved to the US when I was one year old. She remarried a US citizen when I was approximately four years old. This person legally adopted me at this time. My mother became a Permanent Resident of the US and my parents acquired this same status for me. However, since I was legally adopted by a US citizen, shouldn't I have automatically had US citizenship status at the time of my adoption? Thank you for your help and answers. Sincerely, Chad Jubyna
  7. My daughter, her boyfriend and their two minor children have been living with his parents the past few years. His parents got the SS#'s on both kids and filed the 4 of them on their taxes with HIS permission but not my daughters. She wanted to file them herself. This continued the next 2 years and every year she said NO and they did it anyways and gave them a "portion" of the money received. They have just recently moved out from the in-laws home and they are already saying that they are going to file the "kids" again this year,. They have the children's ss#'s .. how can they stop them?

I am the maternal grandmother of 2 minor children and the parents are about to be displaced and want to ensure that the children (if needed) could come to me should they become homeless or incarcerated, ect. Without relinquishing their parental rights, what should we file for? Power of Attorney or Temp Guardianship?
  9. My home was sold at foreclosure auction by Regions Mortgage to Fannie Mae on 7/7/18 for the amount owed on loan which was $93,000, Fannie Mae is now selling it for $185,500. Could I be entitled to any of the equity that is left after fees and charges. Also, I was under the impression the 2 were in some way both the lender.

My girlfriend who is 17 moved in with me and her siblings moved to another county the highschool unenrolled her because we had no proof of residency is her mother going to be charge for truancy? She is not emancipated or anything like that,and will they be able to take legal action to take her from my house shes not a runaway her parents know where she is.
  11. I was pulled over for a clocked 86 in a 70 on interstate 75 three lane. I wasn't going that fast. The cops didnt like to communicate when they pulled me over and won't tell me what details are. It says citation and summons. The cop said I just had to pay a fine but that's not what the ticket says. It's a 10 hour drive from my home in Florida. When calling the number it states it could take 20 days for information. Seems a little Agressive for a speeding ticket. The cop made is sound like it was a lesser ticket but after trying to figure out how to pay it's sounding ridiculous. 40-6-241 state law. Cooks county. Does anyone know the fines details and if I need to plan for a trip up to Georgia? I'm a full time student work full time and my moms been in the hospital for a month icu. (Which is why I was in the situation in the first place)
  12. If you received diversion and then a dismissal in your case (shoplifting) is that a conviction on your record? If you received the Georgia First Offender Act and then a discharge is that a conviction on your record? If you have had a record expunged is that a conviction on your record? If you have had these three things and received a dismissal, discharge, and an expungement (you are one lucky boy!)...three cases....if there were (there is not) a future charge would the court system count the dismissal, discharge, and expungement against you? God bless you for assisting me....I truly appreciate it.
  13. hello, I have a daughter and she is 10 year old, I am undocumented. I came here first time in 1992 and lived until 1996 and went back to Brasil in 1996, Me and my wife arrived in USA in 2003 and my daughter`s birth in may 2006 in Atlanta Ga, I want to know if there is any chance to become legal resident and apply for citizenship in future? I heard on tv about the law enacted in august 2016. How does it work in my case?

  15. Hello, I had purchased an e-book for a college course and I was charged $135.00 for the e-book. However, I do not have access to the e-book anymore because you only have access for the duration of the class apparently,which I found absurd. Additionally, we only had accessed for about 2 months, probably not even a full 2 months since the course was an 8-week class. I have never come across something like this when purchasing e-books. Is there anything that can be done about this situation? Is the legal?
  16. The address on our mortgage paperwork has been wrong ever since we've had it (about 10 years). We didn't even realize it for quite a while ourselves. Frankly, I don't even think about it that often, in the busyness of life, but when I do think about it, it really bothers me. I don't know how it got mixed up, but our property address number is supposed to be 89. It's 89 on our mailing address and it's 89 on our property tax bill. However, on our mortgage paperwork and to our mortgage company, it's 98. When we refinanced with a different company a couple years ago, we brought this up when we signed the paperwork with the attorney who came to our home, and we were told it would be fixed, but it never was, even though he crossed out "98" and wrote "89" on the paperwork we signed. In fact, we had to send the mortgage broker an e-mail saying we were aware that the property address and the mailing address were different, which was fine with us, and we thought nothing else of it. Since then, the refinance has been sold to a different mortgage company, as often happens. There seems to be no problem with the tax bill being paid to our county. They always apply the tax payment from our escrow to the correct property, so the plat number, etc., seems to be fine. However, I am concerned that something might come up about it down the road somewhere, perhaps in connection with insurance (such as if we have a problem that needs to be fixed), or having to do with whether we actually own the property once we pay it off. Whenever I have called the mortgage company about it and they have asked me if the property address and our mailing address were the same, I must admit that I have said yes because they have given me grief about it in the past and when I've called them, I just want to resolve the problem I'm calling them about. I want to fix this, but I am afraid it will create more problems than it will fix, or that it will take a lot of money to fix. Please advise me as to if this is a problem, and if so, how much of a problem it could be and how best to fix it. I really stress about this sometimes. I have read some answers to this and similar questions online and they seem to suggest that as long as the lot number, etc. is correct, there's no real problem. Thanks. Deana S.
  17. Hi All- I need some advice because my apartment is now trying to get money from me due to a mistake they made a few months ago and I'm hoping they aren't able to do that. I recently terminated my lease with my apartment in Georgia. Upon telling them 60 days in advance I was to break my lease, they provided me with paperwork that we both signed that stated everything I had to pay to move out, a "rent to fufill notice" (it was outlined like below). September Rent- $700 October Rent- $200 Termination Fee- $1500 I wrote 2 checks, one for september and october rent for $900 and one for the termination fee for $1500. They signed the above paperwork and also signed & dated a photo copy of my checks to confirm they recieved my payment. Now they are coming back to me saying I owe them $300 dollars because my usual rent is $1000, so the mistake they made (and are now realizing 2 months later) is undercharging me for September rent. However, do I have rights not to pay because they provided me with paperwork of what I owed them to fufill my rent, and they signed it and accepted it, regardless of if they made a mistake. Any advice would be awesome! Thank you
  18. I live in Georgia, if I roll my old 401k to an IRA, is the IRA still protected from creditors in non-bankruptcy events/proceedings? For example if someone tries to sue me in civil court sometime down the road. My understanding is that a Rollover IRA is still protected by Federal law from creditors in bankruptcy events, but state law determines the protection in "non-bankruptcy" events. I would like to how much, if any, protection is provided by Georgia state law from creditors in "non-bankruptcy" events? Thank you kindly for any help!
  19. I am curious about a situation. A friend of mine has confided in me that someone she knows used a date rape drug and violated her. She refused to go to the police because she feels they don't care about the victim. Through facebook I located the person and found he is associated with several people I know. I feel I should warn them of this person, and to simply be weary via text message. Would this count as Libel if it gets back to said person?
  20. Dad passed several years ago, leaving a home which was paid off, in which his widow lives. Ownership is JTWROS in a fee simple estate involving the widow, and the decedent's biological children. Since then widow has moved on, and has a new companion living with her. Neither pay rent; however, the property taxes and insurance are being paid. (and yes, decedent's kids realize we own liability for taxes if they go unpaid.) We are finding the widow to be a bit difficult to discuss business matters (to resolution) and establish boundaries. We wish to sever the JTWROS, realizing we forfeit a portion to the widow instead of selling and splitting proceeds between the siblings once the widow passes away. Is that partitioning an even split, or is it based on some other probate decision of division percentage in GA (as in widow gets 50% and children of deceased split the remaining 50% (the will states "share and share alike")? Is the value the fair market value TODAY, or as of the date of Dad's death? We realize partition is the route to go, or gift to a strawman to force our status to TIC. My question is this - can we charge rent to the widow if we are all TIC (assuming I am not the only sibling to sever the JTWROS for TIC)? Is there any mechanism to charge the companion rent? Another question is that if the live-in companion has paid taxes, does the companion have any stake or claim to adverse possession?

  23. My 82 year old mother is end stages Alzheimer's Disease. She has been in an assisted living facility for almost ten years. Not wanting our mother to have to ever be alone these final days my siblings and I hired a "sitter" to merely hold her hand and talk to her. After a few weeks I started to realize the lady we hired was quite the instigator and not all there. Upon deeper investigation I uncovered that years prior her own family had banned her from seeing her own mother at the exact facility where my Mom is. Furthermore, she had started threatening to sue other residents for violating her civil rights, and the list goes on and on. After presenting this to my siblings we carefully planned a week long strategy to "wean" her out the door in fear of a trumped up lawsuit...to no avail. The same day I had uncovered her past she had posted a picture of herself with my Mom outside Mom's room. Immediately I removed it. The next day she returned it was back up with the writing on the back, "property of her name" I immediately removed it again. The next morning I receive a text message from her husband that he was filing criminal theft charges against me for the pictures and now an apparently missing cell phone charger.(At this point we had her escorted out of the building by administration.) A few day later I received an e-mail from her that unless I returned the pictures and the cell phone charger in an allotted amount of time she would be taking a warrant out for my arrest for criminal theft. The pictures I did take and still have. The cell phone charger, no Idea. Although she claimed in her e-mail that since I was the last one in my mothers room I took it. Including employees, and family/friends that stopped in to see Mom, I'm guessing at least 15 people were in the room. Rewind a few months; I received some traffic tickets which I did not clear up in Georgia. I fly home every week, life got in the way, Georgia doesn't mess around, and of course a warrant was has been issued. (I've already hired an attorney to help me clear this issue up.) But who do you think got a hold of that information...So until the warrant is straightened out, the crazy lady is now using that against me saying, that if I don't return the items she will make sure an investigation into the missing items are executed on me. Basically telling me she'll send the police to the facility to investigate the "theft" and consequently pick me up for the warrant. My initial thoughts were to just return the pictures and buy her a brand new charger. Although, I can guarantee she won't stop. Does this constitute as blackmail? Falsifying a police report? slander? libel? I just want her to go away and leave our family be but I'm afraid if she is not put in her place immediately she will only continue to torment our family.
  24. My Disability company is offering a settlement of 50 % of the value of the policy over its lifetime. What is the usual percentage offered. For example :- 200,000 till age 65 100,000 settlement at present.
  25. My cousin died on July 9, 2016. One week later, his girlfriend sold his car. Her name was not on the title and she did not have power of attorney. I think she forged his name. The family has seen the car being driven by an unknown person. What recourse do we have? Thank you very much.
