  1. On the way to an early morning flight, I was stopped on a local highway exceeding the posted speed limit of 55 at 5:00 AM. The officer who stopped me behaved very cautiously, approaching the passenger side window and checking the car with the flashlight for whatever. After giving my details, he came back from his car with the ticket, presented it to me and told me to "Plead not Guilty." I went to the airport..etc. I pleaded not guilty and took the court date, which is fast approaching. Now, my question: Do I need a lawyer? Do I take his advice and just show up (assuming he will not?). Thanks for any advice.
  2. My dear son was very sadly killed by a train. Following that, an Autopsy had been performed without our consent, in spite of my husband's request (to the officials) of, "NO Autopsy!" I should mention also that my husband was not permitted to see our son on site at the Accident Scene, nor were we permitted to see his body at the County morgue. (Initially they had told us we would have to wait until the following morning to see our son.) The next morning they tell us, "we would only be shown a photograph of your son," if we went down to the morgue. Approx. a year later in retrieving photo's of the accident site and some of the autopsy photo's (from my previous lawyer,) I have viewed my son's body as having been intact and therefore I can't understand "Why", we were NOT permitted to see our son. YET, "two" (t------) officials were present at the time of his Autopsy! My Questions to the above Matter are:(In the state of N.J.) - 1.) Do Police officials have the right to prevent my husband from going to my son's side at the scene of the accident? * I should include that the official on scene had told my husband, "our son had a pulse and that the EMT's were working on him." 2.) Did the Medical Examiner then have the right to fully Autopsy our son without our consent? * Particularly including the following three facts, Initial investigation proved Accidental, our son was only 17, and my husband had requested "NO AUTOPSY!" In attempting to retrieve "additional" Autopsy photo's (of my son's organs,) I have been told , "I can only do so through the request of an Attorney! The Medical Examiner's fee for such photo's is $1,000.00 (100 photo's @ approx. $10.00 each!) I have been informed that although these photo's are contained on a Cd, they could not permit my request of a copy of that Cd (oppose to forwarding the photo's) to help keep the expense of such photo's to a minimum! 3.) Can you tell me what my rights are in retrieving Autopsy photo's? In light of my many unanswered question's regarding my son's death(my son was pronounced via telemetry), what are my rights in regards to me son's tissue remains. (DNA Matrix card, finger print, hair sample, major organ tissue sample's and body fluids.) I thus far have been able to have the above mentioned items retained for a second year, which is now coming near to the end holding date. My concerns are; 4-a.) How many years am I able to request a hold of tissues samples? 4-b.) Am I permitted to continue to make such a request without a lawsuit pending in the moment? 4-c.) Do I have any rights of moving his tissue samples to another appropriate facility if the Medical Examiner's office refuses to continue a hold onto the above items? Please inform me of any law/statutes I should search or "where" I may be able to locate information regarding my rights as a parent in regard to the above stated matter. 5.) Can you advise me to which type of Attorney would best be able to assist me in "ALL" of the above stated issues? *Please also view my second letter to be submitted shortly, "How do I get Answers to My Son's Death?" I'm Hoping someone can answer at least a few of the above questions and/or perhaps guide or direct me to where I may find or research information pertaining to the issues mentioned in this letter. Any information at all would be greatly appreciated. Thank you for your time.
  3. Immigration question: My wife's N400 application was denied because my previous marriage was not terminated until after I got married to my current wife. What can I do to correct this situation, and have my wife application approved??
  4. My father passed away in 2012. So far I have been waiting on my brother to do the right thing and go to court and divide the property equally between all four of our siblings. He said my father did not leave a will. Am I on the right page with this? My brother has been doing some heavy spending and said our father left nothing, I know that to be a lie. What can I do if anything to stop his spending? Also, how can I get him to answer me in court? My brother has so many different tales to tell like our dad gave him power of attorney. Can this influence what I am trying to do? Please help stuck in a rut.

The following question is hypothetical - not in the sense that it didn't happen, because it did, but in the sense that I don't actually want to press charges, rather only to find out if charges could theoretically be pressed. I know the circumstances sound bizarre. But believe me, I'm leaving out some details that make it even more bizarre. Approximately eight years ago, Mr. Smith somehow became convinced based on circumstantial evidence that I have disease X. At the time, I had never even heard of disease X, nor had I experienced any symptoms of it, nor had any doctor examined me for anything even remotely related to it. But Smith would not be dissuaded from his virtual certainty that I was ill. Now, in addition to that belief, Mr. Smith holds the pseudoscientific belief (not supported by modern medicine) that a person can contract disease X by being in situation Y. Compare it, I suppose, to the folk belief that pointing at the moon gives you warts. In any case, Mr. Smith then spent the next eight years repeatedly and deliberately engineering that I would end up in situation Y, over and over and over again. His belief, of course, is that since I already have disease X, situation Y won't affect me at all, so what's the problem? Well, from my point of view, there's nothing to suggest that I have disease X, so putting me in situation Y would actually be pretty injurious to my health if the folk belief were actually true. Since I don't believe that the folk belief is true, I never bothered to take the rather drastic step of severing all contact with Mr. Smith, but I have grown increasingly angry with him at his insistence on repeatedly putting me in situation Y, knowing that he believes it might actually be dangerous to me if he is even the slightest bit wrong in his belief that I already have it. And now comes the kicker. After eight years of this, I went to a doctor for an unrelated matter, and discovered in the process that I actually do have disease X. There is no way I can tell how long I've had it, because the symptoms can go unnoticed for a very long time. I may have developed it as recently as last year, or maybe Mr. Smith was right in asserting that I have always had it. I should also note that Disease X is not curable, though its effects can be wholly negated with proper care. Unfortunately, that care a: involves some minor expenses; b: will significantly reduce my quality of life, and c: must be maintained continuously until the day I die. So long as I have that care, though, I will never even notice the existence of the disease (much like I hadn't noticed it thus far). So to sum up. I am not under the belief that Mr. Smith actually caused me to develop disease X; the folk belief is still, as far as I am concerned, a folk belief. But my question is this: Has Mr. Smith committed any crimes of the "Attempted disease-causing" nature? Regardless of whether or not the charges would stick (I'm pretty sure they wouldn't, even were I inclined to press them), could he theoretically be arrested for his deliberate attempts to put me into what he mistakenly believed was a dangerous situation? Could he be charged on the basis of the fact that there was no way he could know for sure that I had disease X, and that his placing me in situation Y repeatedly may have been potentially dangerous? Or does his first belief (that the situation wouldn't be dangerous for me) negate his second belief (that the situation is dangerous for people in general), leaving him not liable at all?
  6. Let's suppose a 72 yr old married man has been living with his 72 yr old "mistress" for some 30 years. They currently live in a house they co-own (fully paid off) worth approx $350-400k. He has supplied the majority of the financial means throughout their relationship. Each of them has two grown children (not made with each other). His desire, assuming he should pre-decease her, is to leave her with enough assets to live out the rest of her life. He has set up 4 CDs resgistered in his and her names at a bank worth a total of $300k. The CDs have TOD/POD riders on each one bequeathing proportional amounts to the four children (75% to his children and 25% to hers), which reflects his desire that whatever assets are left after she dies (assuming he dies first), should be left 75% to his children and 25% to hers. He also wants the value of the house to be at the same proportion (75% to his kids 25% to hers). There are a few potential issues. -What if, after he dies, she decides to just go and change all the CD accounts at the bank to eliminate the TOD/POD clauses or perhaps change them to cut out his kids? -What if she decides to sell the house and take the proceeds and vanish or just buy a new house of her own with some or all of the money? So, the main issue is, how does he provide the assets he thinks she may need if she lives another 10 years (which may be a stretch, she smoked for 30+ years and just had a tumor removed and an aneurism), while ensuring that any residual assets that may be left over after she dies are distributed to his and her children in the specified proportion of 75-25 respectively. The man was thinking he could create a debt obligation to his children so a lien can be brought against his interest in those assets (the house and the 300k in CDs), to give them leverage, but but I think there's probably a better way? I thank anyone in advance for their thoughts on the matter.
  7. Hello; I own a condominium for 16 years, and according to the rules a cleaning /inspection of the vent dryer must be done every other year. No problems until last year when the company I chose for this job informed me that there's a fire hazard due to the exhaust of dryer vent to the chimney; a violation of the building code. The cost to fix it, $5000. Who must pay for it? I wasn't informed by Condo Assoc. abt. this problem at the time I bought the condo. Thanks, RD
  8. Hi All, I really need your help on the below topic . It would be great to have your suggestions and feedback on this. I have been charged with criminal sexual contact by misunderstanding of the situations. My case refereed in front of grand jury on March 20th. The good news is that,the grand jury decided not to indict me and this case sent back to the municipal court for further investigations. This is not happened so far and i am waiting for their communication. I am Non-Citizen and i am in US with L1 Visa. I am having my engagement on June 8th and planning to leave states for 10 days and will be back to states after my engagement. Will there be any problem in travelling during this time ? Is there any issue with my immigration? My local attorney said there should not be any problem with this .But i need feeback and sugesstion from this forum which will help me alot. Please do the needful with your feedback.

  11. Is there any case law on record regarding being entitled to legal fees if it is well proven and documents that the other party lied. My exwife testified at the trial how sick she was and will never be able to work again. Somehow even though she had zero proof, the judge granted her it based on her "medical condition" however the final day as my ex listen to this, she had a job, she took of the day to be there. So I went for a modification and got awarded a second chance. My ex is looking for me to pay her fees!! I want to ask her to pay me fees. As of know we requested her medical records and a doctor told her NOT to give up on the idea of working. And that she turned down a job. Please tell me if there is a case law on record that would entitle me MY legal fees and NOT pay hers. PLEASE HELP!!! Im in the middle of changing lawyers because mine is very bad.
