  3. I reside in Texas. The parking violation took place in New Mexico. If a municipality has inadequately marked a space in which parking is disallowed and a person receives ticket for parking there, can a defense be made that the municipality is culpable because of the inadequate marking and therefore the ticket should be dismissed?   4. I know that in criminal law, a person has to have INTENT or a different way to say it is that criminal intent is inherent to proving the violation. In a situation of illegal parking, where an argument can be that the parking area was not adequately marked, will the lack of intent to violate the law (innocently parking in the inadequately marked space) even be considered? I live in Texas, the violation was in New Mexico. Thank you
  5. I live in Texas. The following parking violation took place in Mesilla, New Mexico I recently paralleled parked in front of a blue painted indent in the curbing located in the middle of the block. There was no other markings, such as a no parking sign, to indicate that this curb indent was located where it was located. There were cars parked to the right and left of the curb indent. Consequently, when I pulled even with one of the cars to parallel park, I could not see the indention in the curb. I subsequently received a ticket for illegally parking at a curb cut. What are the regulations for marking a curb cut in the middle of the block in Mesilla, New Mexico and how should I proceed to state my case in court.
