  1. My one question is based on our roles in the marriage, could i be entitled to a higher percentage of the properties?
  2. My wife and I have five properties together. We rent 40 apartments. My wife has had zero involvement in managing the properties and that has been my job for the 15 year marriage. We are both on the deed. She is a full-time school teacher. Am I entitled to more than 50% interest if this has been my job? I have made improvements to the properties and I have been the sole person involved with the properties. My wife wants me to liquidate all properties and split the profits, split her pension and retirement. I will then have no income. This was my retirement plan. I would love to know if I have any options.

  4. If my wife is on all the mortgages, wouldn't the income received from the properties be joint income?
  5. She is on the mortgages so she has received the income as well. So, if that is the case, shouldn't she owe spousal support to me? Also, I retired years ago and will just start getting pension this year. I dont' know if I can go back to that job or not. It was just an idea if I now had nothing to do. I was essentially the super of the building. Can I negotiate withholding splitting my pension from her until she retires so I will receive her pension? What am I entitled to? Can you please answer these questions? I have been sleeping on the couch for a year now and would like to move out. Can I do this without jeapordizing anything? If I go back from retirement to my old job to get more of a pension, will my ex wife be entitled to more of my pension if we are divorced?

  7. I am retired with a pension 1800 per month. I was not generating an income because I was paying off mortgages on a few income properties. My wife is a teacher and we were married for over 15 years She filed for divorce. I am going to liquidate all properties and split money. she is not retiring until 62 so I cannot get her pension until then . I am 52 and she is 50 We have one child and we will have joint custody. Residential custody is with the mother. I will have standard visitation. Questions: She makes over 100k. I made nothing but my pension. Am I entitled to spousal support from her and for how long?     pg1067 - Thank you for your answers but I would like a more detailed answer with regard to actual procedure. It seems as though only one person answers each question for the most part.   9. I have filed for divorce. I have filed a motion to get child support. Is there anything a lawyer could do to expedite the process and could someone fill me in on what the process is? I know he was served by a processor on Tuesday and has until December 5th to do something. I am trying to expedite what seems like a painfully slow process to get child support. My husband was paying every month and then bounced May and hasn't paid since. Will a judge ever act quicker because of this? What is a preliminary conference?

    I don't think my lawyer would lie. I am trying to find out if one could schedule an emergency motion so that your case could be heard quickly. If you don't know the answer, fine. Abstract ridiculous responses are a waste of everyone's time. Whoever wrote someone could show up with a pile of money clearly shouldn't be answering questions about NY law. I was hoping to get a few different perspectives about what the best possible out come could be and what is the fastest way to move through this process.

    If I just filed a divorce action and my husband was served this week with a motion (order to show cause) for child support from what I understand, how fast can I get child support? My lawyer said there is no emergency motion possible to try and get child support. Is this true? I am being told that I will not be before a judge before february most likely.
  12. I have information which was sent to me ( i was cc'd) on it which shows that my husband was involved and guilty of stealing an identity and fraudulently creating a ponzi scheme. Can I take this information and turn it in to authorities? He has threatened me and he told me if i try t o hurt him in any way I would end up in jail. He said that i had intent to harm him and that was illegal. His brother is a multi-millionaire hedge fund owner and my husband stole his identity and I want to turn him in and tell his brother. Is this legal? I also found information of forged federal documents and I called authorities and they told me to send it but I don't know if i'll get in trouble? what is the legal and correct way to approach this.

  14. My husband is threatening to send tapes to all of my relatives and friends of us fighting. Can I send him an email to cease and desist from all threats? I am petrified of him and his abusive behavior. Is he allowed to send horrible things about me to my family and friends? Can I prevent this somehow legally? We have not filed for divorce. I am working towards this at the moment.
