If a person dies without a will can they disinherit a family member on there death bed by stating that fact ? And how legal is a letter written to that fact by a lawyer and family member who say they witnessed this action ?

The only way to "disinherit" someone is though a legally valid will. Whether the deathbed statement you described would be valid depends on the state in which it occurred.
