Request for Admissions

2 posts in this topic

In California, when you are requesting Admissions to facts, and you already have 35 of them in a set, can you include additional requests to Admit the genuineness of documents in that same set?

Or since those requests to admit the genuineness of documents would go over the 35 limit, (which was used to admit facts) do those concerning the genuineness of documents have to be propounded in another set? (I'm keeping the request to admit to facts at a 35 limit each time --for now-- and will wait a short time before I propound the next set.)

Thank you.

If you're going to represent yourself in a lawsuit, you really need to review the applicable rules.

Requests to admit or deny the genuineness of documents do not count against the limit of 35. See Civ. Proc. Code Section 2033.030.

Also, the limit of 35 is not 35 per set. It's 35 total. Id.

You may, however, exceed the limit of 35 if you include a declaration under CCP 2033.050. Id.
