asset resolution

My husband and i are going through a divorce,he was awarded child support . because i could not afford an attorney.

The company i worked for failed to take child support out after ordered by the courts.in return the company in wich i worked for was penalized 100 dollars a day for two years.my question is, will this money be considered as marital asset ,since we are not divorced yet ?
