Child support/inheritance

3 posts in this topic

Ive been divorced for about two years now and my ex-wife has not filed for chid support as of yet.I will be recieving a inheritance of about $120,000 very soon. My question is, if my ex-wife files before i recieve my inheritance what if anything is she intitled to? And if she is intitled, how would it be paid,a monthly payment or a lump sum? We live in Delaware and have three kids 10,6 and 3 years old

Child support is based primarily on the parents' incomes, as well as other factors. Since you will have an extra $120k in income in the year that you receive the expected inheritance, the court may take that into account -- either by awarding a lump sum percentage or by increasing your obligation for that particular year. Consult with local counsel.
