In the State of California can an unwed Father request that the baby's name be changed to his last name. The mother named her child with her last name and the father is requesting the court change the baby's last name to his last name.

The father can request anything he wants. However, in California as in most if not all other states, except under highly unusual circumstances both parents' consent is required to change the name of a minor child. Since presumably the mother's consent is not forthcoming and you don't mention any special circumstances, the father's request will probably be denied.

A father's ability to give his child his name is one of the privileges conferred by marriage. When a child is born out of wedlock, the mother gets to choose the name. I'm sorry.

He can request that the baby's name be changed to "Ham Sandwich" or "Lothar of the Hill People" or anything else he wants. Did you seriously think there might be some legal prohibition against him making a request?
