Typically, no. All the state has to do is amend the complaint or indictment. The real issue will be whether the state can show that you were the one who committed the offense, no matter how the name is spelled.

Depends on what "get off" means, on who "they" are, the identity of the state where this occurred, and what the context and relevant facts are.

Again, facts and context are necessary. What is the person charged with? On what did these people misspell the name? Why does the misspelling matter?
