Secede from HOA

Hello:

We are currently trying to sell a piece of property. The title report shows that it is part of an HOA, but the HOA has never charged us, nor have they provided us with any benefits. Our property is fenced outside of the general HOA area and the HOA director states that the parcel we are located in should not be in the HOA. Can we produce a form for release of interest or to secede from the HOA so that we can clear title to close? We'd like to not go to the HOA for a vote and keep the costs down.

Laws vary by State, so please let us know the State you are referring to. It will allow readers to better understand and respond to your post.

It sounds as if the HOA agrees you are not part of the Association, so it may be a simple process to create a document which the HOA representative (director?) can sign. There may be an existing one. Check with the HOA director.

Once we know where you are located, readers of the board may know of ones in your State.

According to the Washington State Legislature:

RCW 64.38.015

Association membership

The

membership of an association at all times shall consist exclusively of

the owners of all real property over which the association has

jurisdiction, both developed and undeveloped.

The director of the HOA has already stated you are not members, and this may help prove that.
