I was recently fired from my waitress job.  My old employer said some of my charge slips were missing, so he fired me. I was not arrested.

 I went for unemployment. I had to have a hearing. It was decided that I was entitled to the unemployment.

After about a month, I received a certified letter from my ex-employer offering my job back. I did not respond because I did not feel safe going back to that old job.

I am afraid of retaliation from my former employer. Many times I was accused of things I did not do. I feel my ex-employer only sent the letter because he wants to get me disqualified for my employment. Also, I am afraid to go back because I think he will try to make it look like I am stealing and get me arrested. I do not feel safe working in that establishment any more.

Also, the owner is a policeman.

I have a hearing in about a week. Will my reasons for not wanting to return to that employer prove good cause for refusal of re-employment?

Does anyone know where I can get some case law to help me when I go to my hearing? Thanks!

If the employer is offering you your job back, you likely won't be eligible for unemployment if you turn it down.

Sorry, but what does this mean?  :)

Over ... what?

Maybe so, but you'd discuss that with the state unemployment folks.

If he wanted to "get [you] arrested", he certainly could have filed a report with the police before.

We cannot know the answer to that from here.
