I am currently a contractor. My dept is currently working to adopt a "statement of work" which would operate outside the current terms. My hiring agency is with whom I signed the contract not with who I will remain working with. This statement of work will necessitate that we "all" sign with thte same contracting company. With that said:

(1) protects the legitimate interests of the employer;

I would not be able to work with the current employer based on the 2 yrs in then 6 mo separation anyway and this is not the same agency that I would need to sign with.

(2) does not impose an undue hardship on the employee; and

This would be an undue hardship based on the economy and the position and status I have attained within the department and organization as a whole.

(3) is not injurious to the public.

this would have no effect on the public

Your post is a bit garbled about what this non-compete says, and whether you're referring to later direct employment with the customer/client (vs. the "hiring agency"/temp agency employer).

You don't actually say what the question is either.  Take the document and situation to a local attorney for review.
