I currently work for a Subcontractor who performs work for DHS. The subcontractor gets $3.56 cents an hour to apply to our H&W benefits. The insurance they have supplied for us is not comparable to the previous employer I had before the Subcontractor. Are they required by law to provide me with insurance that pays as well as my previous insurance.

Question 2: If I want my H&W benefits paid directly to me on my paycheck, is it a law they include this on my check if I ask for it?

No.  (That said, you don't say why you wouldn't have checked out benefits before agreeing to work for them; certainly something to assess before accepting a job.)

I cannot imagine such a requirement in your unnamed state, and I know of no federal law that would require it.

I did check out the benefits before I accepted this job, oh and I'm from Missouri. During orientation before I signed my exceptance letter, I asked all the questions I felt needed to be asked. Unfortunately the insurance rep. advised me incorrectly when answering my questions and when my physician filed an insurance claim it was denied. Something about Missouri does not Mandate weight loss surgery.

Also when I checked on the Department of Labors website, it does say that I can request my fringe benefits be included in the amount I am paid.
