Question from ShannaraNov-3

Hello,

At the moment I am employed by a Town in Connecticut as the Assessor.  Unfortunately I don't know how much longer I may be here.  The problem is, the previous Assessor was not reappoint and she has taken the Town to arbitration.  So far, the CT. Labor Dept., has ruled in her favor that she should be made "whole" and get her job back with benefits and back pay.  She was not reappointed in November of 2007.  Since the CT. Labor Departments decision, the town has taken it a step further, appealed the decision to Superior Court and and Superior Court has determined the same as the Labor Dept.  Again, it was appealed by the Town.  Chances are, appellant court could rule in favor along with the others.  My dilemma, as you can understand would be,.....what if the previous Assessor gets her job back?  What happens to me?  Since I applied for this position in "good faith", I may also lose the position......in which.....I am now a victim as well.  I could lose my house, etc., etc.  What can I do to protect myself just in case?  (other than look for another job, which I have been unsuccessful thus far).   What are your suggestions?

Best not to post your name on the internet, if that's your first name -- esp. since it's unusual (you never know who will do a google search and figure out you're posting).

"What happens to me?"

We cannot know from here.   You don't say what the prior assessor's claim involves; for all we know, it involves unlawful discrimination vs. the town having ignored one of its own civil service regulations (can't imagine towns burdening themselves with a lot of those and having to worry about why it fires folks).

"What are your suggestions?"

It's unclear what you expect folks to tell you from here, given you haven't raised any legal issues in your post and don't mention having a contract with this town.

Seek local counsel if you believe there is a legal issue here (or clarify details in your post).

No, my name is not Shannara.  Shannara is a ficticious name in a castle and dragon type book by Robert Jordan.

Thank  you for your reply.  Although I don't know the details of the case, I only hear from taxpayers that they wanted her out because she was mean to individuals (probably to them), such as demeaning and degrading.  She even through a file folder at someone and hit him in the neck.  People complained to the Board of Selectmen and according to the Town Charter, when there is a new election, the board may or may not reappoint.  Of course, a lot of what I heard is heresay.  Again, I know absolutely nothing other than what people say.  The other problem was that the position was also a Union position.  I can understand what this assessor is going through.  It isn't a good feeling and I'm sure it put her in a very stressful situation, especially with debts to pay.  I don't know the whole situation though.  I don't think I want to know.

I would imagine at this point that if she has to get her position back, since I'm a union person, I should probably be asking them these questions instead.

It's just that, I need to think about my future now.  It's upsetting to know that you may lose your job when you put in for it with good faith, not suspecting something like this would happen.  Sorry for wasting your time.
