Question from JennwithquestionsNov-6
I was pulled over for speeding while I was on vacation last year, 30 in a 25, I think it was. Within 5 minutes of having me pulled over I was handcuffed and put into the police vehicle. The officers wanted to search my car for amphetamines, which I did not have, and I did not give them permission to search my vehicle. While I was sitting in the back seat of the police car, my positive ID came back over the radio, clear with no warrants. The proceeded to take a K9 unit through my vehicle to which they found nothing. After asking me several times whether or not I had "dope" in the car they pulled my boyfriend at the time to the side and said to him "she said there's dope in the car. Where is it?" Out of fear of getting into trouble, he had told them there was a bag of marijuana, about 6 grams, stashed underneath his seat. They proceeded to arrest me since it was my vehicle and this whole ordeal has costed me over $4000.00 dollars, to which I have not completely paid off my balance that I "owe" to them. I feel like I was profiled because of my small size (I am very thin, but definitely do not do amphetamines) and that my boyfriend was coerced into admitting guilt. I feel like my rights were completely violated. I had absolutely no warrants and they searched my vehicle on the basis of "probable cause" because I was speeding after I had specifically told them that they could not seeing as how they DID NOT HAVE a warrant. Should I continue to pay off these fines, or would it be reasonable to try and take this whole things to court as a fourth, fifth, and sixth amendment rights violation?
