What is the sentence for someone who has stolen over $100,000 worth of merchandise at a retail store after hours? The subject has not previous criminal record. The items were given back to the detective when subject was arrested?

The potential sentence depends on the applicable state law, and you did not mention the state. Note that giving back the merchandise taken does not undo the crime. It might, however, be a mitigating factor when the judge decides what sentence to impose or may be a factor in getting a better deal from the prosecutor.
