Question from LEGALISSUE12Nov-3
The State is Louisiana, The arrest was for (2) cts. of Agg. Rape, Mal.in Office, 2nd degree kidnapping, The arrest occurred back in 2007. but no formal charges have been filed by the District Attorney Office. I have been advised that there is time limit on filing charges for the above mentioned crime but I would like to know why? and does this violate the 6th amendment of the Constitution? I have searched for the Louisiana Revised Statue in regards to the Judicial process after you have been arrested and have found that after you are arrested there is supposed to be charges filed of some sort either with in 60 days or 90 days. Can some please give some further in sight on this issue?
