I was pulled over for a DUI and arrested even though my breathalizer was .07, taken for a blood test and then detained.

When I went to court for the DUI, it suddenly became a speeding infraction.  I was not speeding, and was pulled over because the officer said I was weaving and nearly hit another car.  I was trying to get into the slower lane but traffic would not allow it.   No mention of speed.  But suddenly right of the blue I am being charged with speeding. 

If I contest this, can they come back and charge me for DUI even though they have not charged me now?

Also, are the rules regarding leaving the state still in force?  I live in California and need to go out of state for one day.  Do I need to get permission from the court?
