Question from CindarellaOct-31
State of Virginia
Personal Property
On my property, there is a public right of way to a tower from a deed dated back in the early 1900's. The tower is no longer there. Is the right of way still good? Or once a right of way, always a right of way?
Am I held liable if someone gets hurt using this right of way?

You say "public", but isn't this a utility easement?  I doubt any Tom, #### or Harry may use it.  There's likely no way to get rid of it without a lot of hassle, unless you get the party named to have exclusive right of way to sign over their interest in it back to you/essentially letting go of their ROW.

You should discuss with a local real estate attorney.
