I asked my question incorrectly before so I will try again.... if the custodial parent of 2 lives in florida and the non custodial parent lives in NY which state do they go by when figuring out how much child support will be paid?

Depends.  Where did the couple live when they were married/together?  Is there a custody/support order already in place?  If so, in which state was it entered?

not married..together in NY have only a custody agreement in place in NY. Never filed for child support in either state.
