The biological father to my oldest who is only 2yrs of age is a registered sex offender, in and out of prison, and has not paid one dime in child support. Do to these circumstances is there any way I could maybe fill something out for the state of Texas to get his rights terminated at no charge so that my husband can adopt him?

There's no magic form here.  You're free to talk with a local legal aid society to see if they can refer you to large firms with a pro bono practice who might help you and your husband file a petition to adopt/termination of bio-parents rights.  You're also free to call large firms yourself and ask for the name of the partner in charge of the pro bono practice. 

The court system may also have a waiver program where you don't have to pay court filing fees if you can prove you are poor, but court won't waive the fees just for the heck of it/lack of discipline in terms of saving money.  They'll want to see financial info.

Meanwhile, you should be pestering state child support enforcement folks to go after child support owed to you (that might help with the attorney fees).

I've tried that. The problem is he has warrants out and his PO can't find him so the Attorney General's office wont do much to help.
