My x and I divorced and I was to receive 1/2 of his retirement up to the time we divorced.  I have now applied for it.   His union has ok'd the qudro was to go before the Judge to have him sign off.  Was sent back to Lawyer to have the x sign.  I was told we did not need his signature.  Also don't know where he is.  I know the union does as he is retired and collecting.  But they cannot tell me they sent him papers  and he did not respond.  What are the rules of Court regarding this matter.  Thanks

That's QDRO, no "u".

If you had an attorney, that person should have ensured a QDRO was done at the time of the divorce, I'm afraid.  It's unclear why someone thinks that the ex needs to be involved with a court issuing an order that basically orders the plan administrator to do X-Y-Z. 

You also do not say who "they" are (union?) or who "Lawyer" is, but you shouldn't be acting or failing to act based on what some other party says.  ERISA doesn't require that the parties to a divorce sign a QDRO; it's an "order" for a reason -- the court may issue it.  At least that's the way it works to my knowledge. 

I suggest that you seek local counsel of your own on this important matter vs. just waiting to hear what some stranger says about an unnamed state's "Court rules".
