I am in Texas.  I am trying to find out exactly what evidence is needed to prove a mother unfit and how to go about getting this evidence.  There are no drugs involved, but an alcoholic relative is living in the home and caring for the children, 4 and under.  The mother is involved with another man and sleeping together and 2-year-old daughter has been in bed with mom's BF while mom was not home.  Mom has beat kids for the past 2 years.  But I need to know exactly what evidence is needed and how to get it.  Cannot afford a PI.  In Texas, if these things can be proven in court, are the chances good of dad getting kids?  Thanks.

Call CPS( Child Protective Services). They go to the home of where the child is and do their own investigation for abuse. All you have to do is tell them that you believe that there are children being abused and neglected in the residence, then they will go and look into it. Once they are involved, and if they find any abuse, the children should be placed in your temporary care. When that happens, go to the court and petition for custody to be given to you on the grounds of the CPS findings. You could also summon the CPS investigator to your hearing to speak on the childrens behalf as to what the deem fit for the children to live in.
