Question from PorfavorrrOct-30
I am wondering what is required to make a voidable marriage legal? I married a man who petitioned for his marriage dissolution in 1995 while falsly imprisioned. He eventually got released now...its 2009 and he believed he was divorced. We married april 2009. Now we find out that he did not complete the filing. We still want to be married. How do we correct this. He has since filed for default. but we have heard nothing the status remains pending on his dissolution.? and when it does get granted and he does get the divorce...Do we need to get married again, annul, divorce or what. Does he have a waiting period before we can re marry. Just trying to make this all legal. THANK U.

Depends on the laws of your unidentified state.  In my state (Texas) your husband's marriage to you would automatically become valid as soon as his divorce from his first wife becomes final.  Other states have other laws.  Some are like Texas.  In some others, you would have to validate your marriage with a court order after the divorce is final.  In still others, your marriage would be void and you'd have to marry again after having your current marriage annulled.  A local family law attorney can look over the circumstances of your case and advise you what to do.  Good luck!
