Question from JJneedsanswersNov-13
I let my friend borrow my car, and he got in a car accident, unfortunately he passed away, and the passengers ( his wife and kid) were hurt during the accident. The accident was caused by my friend ( the driver ), and since the driver of fault is gone, who is responsible for the medical bills? If my insurance is, if they are only willing to cover part of it, what about the rest? Needs help, and thanks for your answers.

You don't say where you are.  You also don't say what is prompting your questions.  Certainly, in most states the owner of a car is obligated to carry insurance on that vehicle.

If these folks make a claim against your insurance and your insurance agrees that you are responsible as the vehicle owner and pays out policy limits, that's the extent of your insurance company's obligation to you (though they're also obligated to defend you if sued and try to limit your exposure and settle within policy limits if possible).  If these folks sue you and get a judgment beyond your policy limits, only you would know what would happen then.  Might involve your filing bankruptcy.

Thanks Fellen:

But in my case I was not even in the car, and the car was insured, and when I lend my friend the car, he should be fully responsible with the car and the safety of the passengers. I just felt something was not right when my friend drove the car and got in the car accident, then his family sued me for the lost. Can you please tell me what is my right in a situation like this? What should I do?
