I don't really understand what your question is.
You refer to being "penalized if [you] remarry now," but I'm not sure what your concern is.
You also refer to "the 10 year requirement," but I'm not sure what you're talking about. I could take a wild guess, but I'd prefer that you clarify what you're talking about.
By the way, you can get a wealth of information regarding social security eligibility and entitlement at the SSA's web site: www.ssa.gov.

My ex husband is currently on SSI Disability.
This seems to be a consistent misunderstanding. There is no such thing as "SSI Disability". You're either receiving Social Security Disability (SS Disability) alone, or you are receiving SS Disability along WITH SSI (Social Security Income - assistance) because of low income.
SS Disability is based on your life-time work credits (earnings) and has nothing to do with a spouse's income. SSI is income-based, and a spouse's income would have an effect on the benefits you'd receive.
